Terms & Conditions and Cancellations

These Terms & Conditions and Cancellations (“Terms”) apply to all fishing charters, reservations, activities, services, and related experiences offered by **Steady Pressure Sport Fishing**, also known as Maui Sportfishing (“Maui Sportfishing,” “Steady Pressure,” “we,” “us,” or “our”).

By making a reservation or participating in a Maui Sportfishing charter, you acknowledge that you have read, understood, and agreed to these Terms.

Reservations and Payment

All reservations are subject to availability and are not considered confirmed until confirmation has been provided through our authorized booking system.

Maui Sportfishing offers private and shared sportfishing charters, including 4-hour, 6-hour, 8-hour, and 10-hour charter options. Charter availability, pricing, duration, and inclusions are subject to the information displayed at the time of booking.

Unless otherwise stated during the booking process, reservations are paid in accordance with the payment terms presented at the time of booking.

Prices may be subject to applicable taxes, fees, gratuity, or other charges disclosed during the reservation process.

Guests are responsible for reviewing their reservation confirmation and notifying us promptly if any information is incorrect.

Charter Availability

Maui Sportfishing operates fishing charters from Maʻalaea Harbor on Maui.

Our charters are subject to weather, ocean conditions, harbor conditions, fishing conditions, equipment availability, vessel requirements, government regulations, and other circumstances that may affect the safety or operation of the charter.

We do not guarantee that guests will catch fish or catch a particular species or quantity of fish.

Fishing is an outdoor activity subject to natural conditions, and the results of each trip may vary.

Charter Capacity

Our vessel is licensed to accommodate up to **six guests**, subject to applicable regulations and the requirements of the particular charter.

The number of participants must not exceed the maximum capacity permitted for the vessel or charter.

Maui Sportfishing reserves the right to refuse participation when a reservation exceeds the permitted capacity or otherwise does not comply with applicable safety or operating requirements.

Cancellation by Guests

All cancellation requests should be made as soon as possible and should include the reservation name, charter date, and confirmation information.

Unless different cancellation terms are specifically stated in the reservation confirmation, cancellation requests will be handled according to the applicable cancellation terms provided at the time of booking.

Cancellation fees, if applicable, may be based on the amount of notice provided before the scheduled charter.

Because fishing charters involve advance vessel scheduling, crew, fuel, equipment, and operational costs, late cancellations may result in the loss of some or all of the reservation payment.

No-Shows

No refunds will generally be issued for guests who fail to appear for their scheduled charter.

A no-show may include:

  • Failing to arrive at the designated departure location
  • Arriving too late to participate in the scheduled charter
  • Failing to respond to reasonable attempts to contact the guest
  • Providing incorrect or incomplete reservation information
  • Voluntarily choosing not to participate after the charter has commenced or after services have been provided

Guests are responsible for allowing sufficient time to reach Maʻalaea Harbor and the designated meeting location.

Changes to a Reservation

Requests to change the date, time, number of guests, charter type, or other reservation details should be made as early as possible.

Reservation changes are subject to availability and may be subject to additional charges or cancellation terms.

A requested change is not guaranteed until it has been confirmed by Maui Sportfishing.

Weather and Ocean Conditions

Maui’s ocean and weather conditions can change quickly.

The Captain and/or Maui Sportfishing management has the authority to determine whether a charter can safely operate.

Factors considered may include:

  • Wind
  • Waves
  • Ocean conditions
  • Storms
  • Lightning
  • Visibility
  • Harbor conditions
  • Marine warnings
  • Vessel safety
  • Government restrictions
  • Other conditions that may affect the safety of guests or crew

The decision to cancel, postpone, modify, or terminate a charter for safety reasons will be made by Maui Sportfishing and/or the Captain.

Guest preference alone does not determine whether a charter will operate.

Cancellation by Maui Sportfishing

Maui Sportfishing may cancel or postpone a charter when weather, ocean conditions, mechanical issues, government restrictions, safety concerns, or other circumstances make it unsafe or impractical to operate.

When a charter is canceled by Maui Sportfishing because of bad weather or other circumstances affecting safe operation, we will make reasonable efforts to **reschedule the charter for another available date during the guest’s stay**.

If rescheduling is not possible, Maui Sportfishing will generally provide a **100% refund of money paid for the fishing trip**, consistent with the policy stated on our website.

Refunds do not necessarily include costs paid separately to third parties, including fishing-license fees, travel expenses, accommodation, transportation, meals, or other unrelated expenses.

Fishing License Requirements

All participants who are required by Hawaii law to have a fishing license are responsible for obtaining the appropriate license before participating in the charter.

The State of Hawaii may require individual participants to register online and obtain a fishing license.

Certain individuals may be exempt from licensing requirements under Hawaii law, including certain children, active-duty military personnel and their families, and Hawaii residents, subject to applicable requirements.

Guests should verify the current requirements with the State of Hawaii before their charter.

Maui Sportfishing is not responsible for changes to government licensing requirements.

Important Fishing License Notice

Guests are encouraged **not to purchase a Hawaii fishing license too far in advance of their charter**.

If a fishing trip is canceled because of weather or another event, the State of Hawaii may not refund the fishing-license fee.

Fishing-license fees are separate from the charter price and are not controlled by Maui Sportfishing.

Fishing Regulations

Guests must comply with all applicable federal, state, county, and local fishing regulations.

These may include regulations concerning:

  • Fishing licenses
  • Size limits
  • Catch limits
  • Protected species
  • Seasonal restrictions
  • Gear restrictions
  • Bag limits
  • Fishing areas
  • Reporting requirements
  • Other marine-resource regulations

Maui Sportfishing reserves the right to refuse or discontinue fishing activity that would violate applicable law or regulations.

Guests are responsible for following the instructions of the Captain and crew regarding lawful and safe fishing practices.

Catch and Fish Handling

Fishing success is not guaranteed.

The Captain and crew may provide guidance regarding the handling, retention, release, or processing of fish in accordance with applicable regulations and local practices.

Whether a guest may keep a particular fish depends on applicable laws, regulations, size limits, species restrictions, catch limits, and other requirements.

Maui Sportfishing does not guarantee that guests will be able to keep a particular fish.

Where appropriate and subject to applicable practices, smaller fish may be cleaned or filleted for guests.

Fish exceeding the size or weight limitations communicated by the crew may not be cleaned or filleted.

Guests are responsible for providing appropriate arrangements for transporting or storing any fish they retain.

Guest Responsibilities

Guests must:

  • Follow all instructions given by the Captain and crew
  • Follow applicable fishing regulations
  • Follow all vessel safety procedures
  • Remain in designated areas when instructed
  • Use fishing equipment responsibly
  • Treat crew members and other guests respectfully
  • Inform the crew of relevant safety concerns
  • Avoid behavior that could endanger themselves or others
  • Comply with applicable laws and regulations

Maui Sportfishing may refuse participation or terminate a guest’s participation if the guest behaves in a dangerous, abusive, disruptive, threatening, or unlawful manner.

No refund is guaranteed when a guest is removed from a charter because of unsafe, disruptive, or unlawful behavior.

Alcohol and Drugs

Guests must not bring or consume illegal drugs on the vessel.

Alcohol consumption is subject to applicable law, vessel rules, and the instructions of the Captain and crew.

A guest who is intoxicated to a degree that creates a safety concern may be refused boarding or removed from the charter.

No refund is guaranteed when participation is refused or terminated because of intoxication, illegal drug use, or unsafe behavior.

Children and Minors

Families and children are welcome on Maui Sportfishing charters, subject to applicable safety requirements.

Parents and legal guardians are responsible for supervising minors during the charter.

When multiple young children participate, Maui Sportfishing may require an appropriate number of adults to accompany and supervise them.

Guests should notify Maui Sportfishing in advance of any special needs or circumstances involving children.

The Captain may make safety-related decisions regarding the participation of a minor based on weather, ocean conditions, vessel conditions, and other circumstances.

Health and Physical Requirements

Fishing charters involve time aboard a moving vessel and may involve exposure to:

  • Ocean motion
  • Wind
  • Sun
  • Heat
  • Rain
  • Changing weather
  • Uneven or moving surfaces
  • Fishing equipment
  • Boat movement
  • Other normal maritime conditions

Guests are responsible for determining whether they are physically capable of participating safely.

Guests who have medical concerns, mobility limitations, motion-sickness concerns, or other conditions that may affect participation should consult an appropriate medical professional before booking.

Maui Sportfishing does not provide medical advice.

Seasickness and Motion Sickness

Guests should be aware that seasickness or motion sickness is a possible risk associated with boat travel.

Maui Sportfishing cannot guarantee that a guest will not experience seasickness.

Guests who are concerned about motion sickness should consult a qualified medical professional regarding appropriate preventive measures before the charter.

A guest choosing not to participate because of seasickness or discomfort does not automatically qualify for a refund.

Vessel and Safety Requirements

Guests must comply with all instructions provided by the Captain and crew regarding vessel safety.

The Captain has final authority regarding operational and safety decisions during the charter.

Guests may be required to wear or use safety equipment when instructed.

Guests must not interfere with vessel operations, navigation equipment, fishing equipment, or crew activities.

Personal Belongings

Guests are responsible for their personal belongings.

Maui Sportfishing is not responsible for lost, stolen, damaged, or misplaced personal property except where liability cannot legally be excluded.

Guests should avoid bringing unnecessary valuables aboard the vessel.

Photography and Media

Maui Sportfishing may photograph or record guests during fishing charters for operational, promotional, educational, or marketing purposes.

Where required by applicable law, appropriate consent will be obtained.

Guests who do not wish to appear in promotional photographs or videos should notify Maui Sportfishing.

Assumption of Risk

Sportfishing and boating involve inherent risks that cannot be completely eliminated.

These risks may include, but are not limited to:

  • Rough or changing ocean conditions
  • Waves and vessel movement
  • Slippery or wet surfaces
  • Falls
  • Fishing hooks and equipment
  • Fishing lines and tackle
  • Fish and marine wildlife
  • Sun exposure
  • Heat
  • Wind and rain
  • Seasickness
  • Vessel movement
  • Boarding and leaving the vessel
  • Other risks associated with ocean travel and recreational fishing

Guests may be required to complete and sign an applicable waiver, release, risk acknowledgment, or other participation document before boarding.

The applicable waiver may contain additional terms regarding assumption of risk, releases, and limitations of liability.

Captain’s Authority

The Captain has final authority regarding the safe operation of the vessel.

The Captain may change the route, fishing location, duration, activity, or itinerary when reasonably necessary because of weather, ocean conditions, safety concerns, vessel conditions, fishing regulations, mechanical issues, or other circumstances.

Guests must follow all reasonable instructions given by the Captain and crew.

Fishing Results

Maui Sportfishing does not guarantee that guests will catch fish.

Fishing conditions are affected by numerous factors outside our control, including:

  • Weather
  • Ocean conditions
  • Water temperature
  • Fish movement
  • Seasonal conditions
  • Marine activity
  • Fishing pressure
  • Natural conditions
  • Other environmental factors

The purchase of a fishing charter is payment for the charter service and experience and not a guarantee of a particular catch.

Charter Duration

Charter durations are based on the option selected during booking.

Departure and return times may vary because of weather, ocean conditions, harbor conditions, safety requirements, or other circumstances.

A charter may be shortened, modified, or ended early when the Captain determines that continuing would be unsafe or impractical.

Modifications to Charters

Maui Sportfishing may modify the charter route, fishing location, schedule, or activities when reasonably necessary.

Modifications may occur because of:

  • Weather
  • Ocean conditions
  • Fishing conditions
  • Mechanical issues
  • Safety concerns
  • Government restrictions
  • Harbor conditions
  • Equipment issues
  • Other circumstances beyond our reasonable control

A modification does not necessarily entitle a guest to a refund.

If a significant portion of a charter is canceled by Maui Sportfishing after services have begun, management may determine whether a partial refund or other accommodation is appropriate based on the circumstances.

Force Majeure

Maui Sportfishing shall not be responsible for failure or delay in providing services caused by circumstances beyond our reasonable control.

Such circumstances may include:

  • Severe weather
  • Hurricanes or tropical storms
  • High winds or waves
  • Natural disasters
  • Harbor closures
  • Government restrictions
  • Emergency conditions
  • Mechanical or infrastructure failures
  • Labor disruptions
  • Transportation disruptions
  • Public emergencies
  • Other unforeseen circumstances

When such circumstances occur, Maui Sportfishing may reschedule, modify, postpone, or cancel the affected charter.

Third-Party Services

Reservations or payments may be processed through third-party booking, payment, or technology providers.

Third-party services may have their own terms and privacy policies.

Maui Sportfishing is not responsible for the independent policies or practices of third-party service providers.

Guests should review the applicable third-party terms before submitting payment or personal information.

Refunds

When a refund is approved, it will generally be issued to the original payment method.

Processing times may vary depending on the payment processor, bank, or credit-card company.

Maui Sportfishing is not responsible for delays caused by financial institutions or third-party payment processors.

Unless otherwise stated, refunds apply only to amounts paid directly to Maui Sportfishing.

Fees paid to government agencies or other third parties may not be refundable by Maui Sportfishing.

Travel and Related Expenses

Maui Sportfishing is not responsible for expenses incurred by guests in connection with a canceled, delayed, shortened, or modified charter.

Such expenses may include:

  • Airfare
  • Hotels
  • Rental cars
  • Transportation
  • Meals
  • Fishing-license fees
  • Other activities
  • Travel insurance
  • Other personal expenses

Guests are encouraged to consider appropriate travel insurance for non-refundable travel expenses.

Changes to These Terms

Maui Sportfishing may update these Terms from time to time to reflect changes in our services, booking practices, business operations, or applicable laws.

When changes are made, the “Last Updated” date will be revised.

The Terms generally applicable to a reservation will be those presented to the guest at the time of booking, unless otherwise required by law.

Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable in the State of Hawaii, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute arising from these Terms or services provided by Maui Sportfishing shall be subject to the jurisdiction of the appropriate courts in Hawaii, unless otherwise required by applicable law.
